ORDER 1. This is first bail application under section 438 of Cr. P.C. filed by the applicant for grant of anticipatory bail. 2. The applicant is apprehending her arrest in connection with Crime No. 361/12 registered at Police Station Chanderi District Ashoknagar (M.P.) for an offence punishable under sections 304 B and 498 A of IPC. 3. The allegation against the applicant is that she alongwith other family members had demanded dowry from the deceased, due to which, she was died. The body of the deceased was found in a well, nearby the house. The present applicant is sister-in-law of the deceased and she is a student, aged about 18 years. As per the statement of the father of the deceased, the present applicant and other family members had demanded a motor cycle. 4. Learned Public Prosecutor opposed the bail application and proyed for its rejection. 5. Looking to the facts of the case and also considering the fact that the present applicant is sister-in-law of the deceased and she is a student, aged about 18 years, but without expressing any opinion on the merit of the case, the application is allowed and it is directed that in the event of arrest, applicant be released on bail on her furnishing a personal bond in the sum of Rs. 50,000/-(Rupees Fifty Thousand Only) with one solvent surety in the like amount to the satisfaction of the arresting officer with the condition that as and when she will be required, she will appear before the investigating officer and shall cooperate in the investigation. The applicant shall also comply with the conditions enumerated under section 438(2) of Cr. P.C. 6. A copy of this order be sent to SHO, Police Station concerned for necessary information and compliance.
