S.C. Agarwal, J.;— Heard learned counsel for the applicant and learned AGA for the State and perused the record. 2. Learned counsel for the applicant submitted that deceased Kali charan cousin of complainant has illicit relation with Smt. Munni wife of cousin Lallu. The deceased used to give his income to Smt. Munni in spite of own family. Due to that family members including son-in-law of the family were displeased with Kali Charan. The incident took place on 19.10.2011. It appears that due to dispute and altercation he committed suicide by putting himself on fire. The FIR was lodged on 25.12.2011 after two months of incident on the basis of suspicion and with allegation that he was assaulted and put on fire by the applicant and other co-accused. Had the son or any other witnesses has seen the incident this must have disclosed earlier at the time of panchayatnama. The allegation is that secretly complainant and other persons get information that applicant and other accused set him on fire. When report was not registered then application was moved under section 156(3) Cr.P.C. and by order of the court first information report was lodged. He further submitted that applicant will not misuse the liberty of bail and he will cooperate with the trial if he is released on bail. In the present case, applicant is in jail since 16.4.2012. 3. Learned A.G.A. has opposed the prayer for bail. 4. Co-accused Smt. Chandra Kaliya having identical role has been granted bail by this Court vide order dated 01.06.2012 passed in Criminal Misc. Bail Application No.13767 of 2012. 5. In these circumstances the applicant is also entitled to be released on bail on the ground of parity. 6. In view of the above facts and circumstances of the case, I find it to be a fit case for bail. 7.

Let the applicant Ram Karan involved in Case Crime No.138 of 2011, under Sections 302 and 201 I.P.C., Police Station Pailani, District-Banda be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned and also subject to the following conditions: (a) The applicant shall attend the court according to the conditions of the bond executed by him; (b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence. _
