JUDGMENT Mr. Ram Chand Gupta, J.(Oral) - CRM No.61183 of 2012 Requests for placing on record copy of Zimni orders passed by learned trial court as Annexure P4. The same are taken on record subject to all just exceptions. CRM stands disposed of. Main 1. This is an application for regular bail filed under Section 439 of Code of Criminal Procedure in FIR no.311 dated 29.10.2011, under Sections 302/148/149 IPC and Section 25 of Arms Act, 1959 registered at police station Adampur, District Hisar. 2. I have heard learned counsel for the parties and have gone through the whole record including the impugned order passed by learned Additional Sessions Judge, Hisar dismissing bail application filed on behalf of the petitioner. 3. It has been contended by learned counsel for petitioner-accused that he has not been named in the FIR. It is further contended that he is being implicated in this case on the alleged confessional statement of main accused and however, the same cannot be used against him in the absence of any substantive evidence against him. It is further submitted that his alleged confessional statement recorded by the police while he was in police custody also cannot be used against him. It is further submitted that knife, which was allegedly recovered from his possession at the time of his arrest, was not used in the crime. It is further contended that he has been continuing in custody since 15.11.2011 and that trial has not been concluded so far. 4. The factual position that knife allegedly recovered from possession of petitioner-accused was not used in the crime, has not been disputed by learned counsel for the State. He has also stated that there is no evidence against petitioner-accused except confessional statement of coaccused and confessional statement of petitioner given to the police. He has also admitted that no recovery was effected from petitioner-accused pursuant to disclosure statement. 5. There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. 6. Hence, keeping in view these facts and without expressing any opinion on merits, the instant application for regular bail filed on behalf of Kanha Ram is allowed. 7. Bail to the satisfaction of CJM/Duty Magistrate, Hisar.
