JUDGMENT Mr. Mehinder Singh Sullar, J.: (Oral) - Petitioners Satyabir Singh and others have preferred the instant petition for the grant of anticipatory bail in a case registered against them, by virtue of FIR No.17 dated 17.1.2012 (Annexure P1), on accusation of having committed the offences punishable under sections 406, 498-A and 506 read with section 34 IPC by the Police of Police Station Nissing, District Karnal, invoking the provisions of section 438 Cr.PC. 2. Notice of the petition was issued to the State. 3. After hearing the learned counsel for the parties, going through the record with their valuable help and after considering the entire matter deeply, to my mind, the present petition deserves to be accepted in this regard. 4. During the course of preliminary hearing, the petitioners were granted ad interim anticipatory bail, to enable them to join the investigation, by a Coordinate Bench of this Court (Rajan Gupta, J.), vide order on 18.4.2012. 5. Sequelly, the following order was passed on 23.5.2012:- “Learned counsel for the petitioner contends that petitioners are ready to pay an amount of Rs.5.00 lacs to the complainant at this stage. Learned counsel for the complainant submits that he is ready to accept the said amount without prejudice to the rights of the complainant to agitate regarding rest of the dowry articles handed over at the time of marriage. To enable the petitioners to do the needful, adjourned to 18.7.2012. Interim order to continue.” 6. In compliance thereof, learned counsel for petitioners intends to hand over a draft of amount of Rs. 5 lacs, but the counsel for complainant did not accept as its validity date has expired. 7. Faced with the situation, the learned counsel has submitted that petitioners are prepared to hand over a new valid draft of the sum of Rs. 5 lacs to the complainant, in pursuance of order of this Court. 8. It is not a matter of dispute that marriage of complainant Sonia was solemnized with Sandeep Pundir (since deceased), according to Hindu rites & ceremonies on 12.11.2010 in village Shambhli, District Karnal. Sandeep Pundir, husband of complainant, had died. Petitioners Satyabir Singh and Shiksha Devi are parents-in-law, whereas petitioner No.3 Netre Pal @ Sonu is brother-in-law (Devar) and petitioner No.4 Amrita is sister-in-law (Nanand) of the complainant. They were stated to have already joined the investigation.
Sandeep Pundir, husband of complainant, had died. Petitioners Satyabir Singh and Shiksha Devi are parents-in-law, whereas petitioner No.3 Netre Pal @ Sonu is brother-in-law (Devar) and petitioner No.4 Amrita is sister-in-law (Nanand) of the complainant. They were stated to have already joined the investigation. They are ready to pay a sum of 5 lacs to the complainant. 9. In the light of aforesaid reasons, the instant petition for anticipatory bail filed by the petitioners is accepted. The interim bail already granted to them by this Court, vide orders dated 18.4.2012 and 23.5.2012 is hereby made absolute, subject to payment of amount of Rs. 5 lacs within a period of one week to the complainant. However, it is made clear that if the petitioners fail to make the payment of indicated amount, then, the petition for anticipatory bail would be deemed to have been dismissed in this regard. ---------0.B.S.0------------
