Judgment :- 1. The writ petition is filed for mandamus directing the respondents not to disturb the petitioners' peaceful possession and enjoyment of the property in Survey No. 52/1 without resorting to the due process of law. 2. The learned Government Advocate appearing for the respondents states that the authorities would proceed with the matter in accordance with law and the provisions of the Land Acquisition Act will be followed, if the land belong to the petitioners as stated therein. Further more, for the purpose of laying the road the respondents have proceeded with the consent of the land owners, who own lands adjacent to the existing Panchayat Union road and therefore the allegation of the petitioners is denied. In para 7 of the counter affidavit by the respondents 2 and 3, it is stated that there is no interference to the petitioners' possession and enjoyment of the property and only where the land owners have given consent the improvement of road has been taken up. Recording the said statement, the writ petition is closed. No costs.
