JUDGMENT 1. - The present bail application has been filed under Section 439 Criminal Procedure Code The petitioner has been arrested in connection with F.I.R. No. 84/2010 registered at Police Station Kalilnjara, District Banswara for the offences under Sections 450, 395 and 397 I.P.C. 2. Heard learned counsel for the petitioner, learned Public Prosecutor and perused the challan papers. 3. The learned counsel for the petitioner submits that the petitioner is in custody since 12.5.2010. Co-accused Daula, Jai Singh and Rasan, against whom identical allegations have been levelled, have already been directed to be released on bail by this Court. Therefore, he prays that the petitioner, who is in prolonged custody, also deserves to be released on bail. 4. The learned Public Prosecutor has opposed the bail application. 5. Having considered the facts and circumstances of the case, particularly the fact that the accused-petitioner is in custody for the last more than two years and the fact that other co-accused persons in this case have been granted bail by this Court, the instant bail application also deserves to be allowed.Accordingly, the bail application is allowed. It is ordered that accused- petitioner Ratan @ Ratna S/o Shri Meghu, in F.I.R. No. 84/2010, registered at Police Station Kalinjara, District Banswara shall be released on bail; provided the furnishes a personal bond of Rs. 50,000/- and two surety bonds of Rs. 20,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do till the completion of the trial.
