JUDGMENT 1. - Heard. 2. Counsel appearing on behalf of the petitioner has submitted that application under Section 90(b) of the Rajasthan Land Revenue Act(hereinafter referred to as 'the Act') has not been decided so far. In order dated 22.02.2008 passed by Division Bench of this Court in D.B. Civil Special Appeal(Writ) No. 1277/2007, it has been mentioned that application under Section 90(b) of the Act has been accepted. 3. It is admitted by counsel appearing on behalf of the petitioner, on a query being made, that there is no direction issued by this Court to decide the application under Section 90(b) of the Act, same is stated to be pending. In the absence of any direction, no case is made out for contempt. 4. Consequently, counsel appearing on behalf of the petitioner has prayed for withdrawal of the contempt petition with liberty to take recourse to appropriate proceedings for decision of the application. 5. Liberty is available. We need not to grant it here. Maintainability of such petition has to be examined, as and when it is filed. 6. Notices of contempt are discharged. Contempt petition is disposed of.Petition dismissed. *******
