JUDGMENT Mr. Ram Chand Gupta, J.: (Oral) - This order will dispose of both the aforementioned petitions filed for regular bail under Section 439 of Code of Criminal Procedure in FIR no. 214 dated 26.12.2009, under Sections 307/324/323/427/148/149 IPC and Section 27 of Arms Act, 1959 (Sections 325/326 IPC have been added and Section 27 of Arms Act, 1959 has been deleted later on), registered at police station Sadar Sangrur, District Sangrur. 2. I have heard learned counsel for the parties and have gone through the whole record including the impugned order passed by learned Additional Sessions Judge, Sangrur dismissing bail applications filed on behalf of the petitioners. 3. It has been contended by learned counsel for petitioners-accused that petitioners-Balkar Singh @Balkari and Jagtar Singh @Bitti have been continuing in custody since 11.10.2010 and petitioner-Hardeep Singh @Dainger has been continuing in custody since 21.06.2010. It is further contended that trial is not being concluded as some other persons have been summoned to face trial alongwith petitioners-accused by allowing application filed under Section 319 Cr.P.C. by the prosecution and that they are yet to appear before learned trial court and hence, de novo trial would start. It is also contended that no specific injury on any vital part of the body has been attributed to present petitioners-accused. 4. This factual position has not been disputed by learned counsel for the State, on instruction from ASI Jarnail Singh, except that petitioners-accused had given Kirpan blows by reverse side to Deep Singh and another injury on the hand of Deep Singh. 5. There are no allegations on behalf of the State that petitioners are likely to abscond or that they are likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. 6. Hence, keeping in view these facts and without expressing any opinion on merits, both the applications for regular bail filed on behalf of Balkar Singh @Balkari, Jagtar Singh @Bittu and Hardeep Singh @Dainger are allowed. 7. Bail to the satisfaction of CJM/Duty Magistrate, Sangrur.
