Hon'ble Amreshwar Pratap Sahi,J.— Heard learned counsel for the petitioner and Sri Anurag Khanna for the respondent No.2. The petitioner claims a weightage of 5% in relation to his candidature for U.P. Combined Pre-Medical Test 2012. The submission is that petitioner's father is a Green-card Holder and, therefore, the benefit should be given keeping in view the aforesaid fact as such benefits have already been extended in other States as well. He further contends that according to the brochure; copy whereof has been filed as Annexure-1 to the writ petition, there was an announcement by the State Government of U.P. also to that effect. I have perused the said brochure and the category of reservation as entailed in the brochure does not indicate any such weightage. The news item at the tail end of the document which is being described as a brochure is being relied upon by the petitioner. The source whereof has been disclosed as from the Times of India. A news item cannot partake the shape of Rules or Regulation and it cannot be read as part of the brochure. There is no other provision in any other document so as to extend such benefit. The argument is that such a benefit is being provided all over India cannot entitle the petitioner to claim the said benefit as a matter of right so long as the said benefit is not extended by the State Government. Learned counsel for the petitioner submits that a Green-card, which has been issued to the petitioner's father at clause 3 mentions the extension of such benefit. In the opinion of the Court, the Green-card by itself cannot be the basis for benefit so long the brochure and the regulations framed for the examination are not accordingly amended for incorporating such conditions. Even otherwise clause-3 of the Green-card only talks of preference being given for admission in Government and Government aided Schools with a rider that no fee shall be charged in class 12. This clause nowhere extends the benefit of weightage of 5% marks in a competitive examination like the CPMT. If this information is not provided in the brochure then extending benefit to the petitioner would also violate Article 14 of the Constitution of India as other candidates of such category would be discriminated. There is no merit. The writ petition is dismissed. _
