ORDER PRAKASH CHANDRA VERMA, J. A supplementary affidavit has been filed in the office. Let the same be placed on record. 2. After hearing learned counsel for the parties, we are of the view that since there was already an existing road, there may be no question of seeking acquisition of land. If any portion of the land of the private respondents has been taken for construction of road, compensation to them shall be paid by the State of Bihar in accordance with the provisions of the Land Acquisition Act on market value of the land as on the date when the construction was started. If the survey has been conducted, the Collector shall ensure payment of compensation to the losers of the land within a period of three months. The order of the learned Single Judge is modified to this extent. 3. Subject to the above observation, this appeal is disposed of.
