JUDGMENT Jaya Roy, J. – The appellants have filed all these appeals separately for setting aside the same Judgment of conviction and the order of sentence dated 25.08.2003 passed by the Ist Additional Sessions Judge, cum-Special Judge, C.B.I., Dhanbad in R.C. No. 21(A)/1986 whereby the appellants have been convicted to undergo Rigorous Imprisonment for Two years and to a fine of Rs. 1000/- under Section 409 I.P.C. and they have been further sentenced to undergo Rigorous Imprisonment for two years under Section 5(2) read with 5(1)(d) corresponding to under Section 13(2) read with 13(1) (d) of P.C. Act. 1988 and also sentenced to pay a fine of Rs.1000/- under Section 477-A I.P.C. and under Section 9B(b) of the Explosive Substance Act. 1984. in each count. In case of default in payment of fine, the appellants have been further sentenced to undergo simple imprisonment for three months and all the sentences will run concurrently. 2. The learned counsels appearing for the appellants and C.B.I. have filed written argument separately and the same are kept in the record. 3. The prosecution case in brief is that the informant G.P. Verma, D.S.P. CBI, Dhanbad received information through reliable source to the effect that Chandra Deep Singh and Chhota Jodhi Mahto while working as Magazine Incharge and Explosive carrier respectively in Damoda Colliery, Area-I, BCCL, Dhanbad during the period April to June 1985, entered into a Criminal conspiracy between themselves and others of Damoda Colliery as well as Kessargarh Colliery of Block-II,BCCL in pursuace to which they criminally misappropriated various types of detonators, explosives and fuses to the tune of Rs.1,66,674.77 approximately. It is also alleged that from 2.4.85 to 30.4.85 Chhota Jodhi Mahato received 24,278 numbers of various types detonators against 14 D.Ts. issued by the Manager/Agent of the Damoda Colliery, from the Keshargarh Colliery of Block-II likewise during the month of May' 1985. 29,122 pieces of various types of detonators were received by Chhota Jodhi Mahato and Chandradeep Singh between 6.5.85 to 28.5.85 against 14 D.Ts issued by Damoda Colliery. In June 1985, another 4,156 pieces of detonators were received by Sri Chhota Jodhi Mahto from Keshargarh colliery against 5 D.Ts issued from 19.6.85 to 25.6.85.Thus, a total of 57,556 numbers of detonators were received by the accused persons from Keshargarh Colliery of Block-II BCCL from April, 1985 to June 1985, total value of which is Rs.1,17,364.14 approximately.
In June 1985, another 4,156 pieces of detonators were received by Sri Chhota Jodhi Mahto from Keshargarh colliery against 5 D.Ts issued from 19.6.85 to 25.6.85.Thus, a total of 57,556 numbers of detonators were received by the accused persons from Keshargarh Colliery of Block-II BCCL from April, 1985 to June 1985, total value of which is Rs.1,17,364.14 approximately. However, the detonators received by the accused persons from the Keshargarh Colliery were not accounted for in the explosives stock Register maintained in the Colliery by them and were criminally misappropriated by them. It is further alleged that accused Chhota Jodhi Mahato received 123 pieces of explosives on 15.4.85, 25.4.85 and 28.5.85 from Keshargarh Colliery of Block-II against 5 D.Ts valued at Rs.44,564-23 approximately and their receipts were not accounted for in the explosive stock Register of the Colliery. It is further alleged that the two accused persons received 600 fuse coils during the month of April and May1985 from Keshargarh Colliery against 4 D.Ts. valued at Approximately Rs.4,745.86 and did not account for the same in the stock of Damoda Colliery. A case has been registered i.e. R.C. Case No. 21(A)/1986 against the accused namely Chandradeep Singh and Chhota Jodhi Mahato. 4. After investigation, charge sheet has been submitted against Chandra deep Singh, Chhota Jodhi Mahato and three other persons namely K.P. Singh (Agent), A.N. Yadav (Manager of Damoda Colliery) and Ram Nath Pandey (Magazine incharge of Keshargarh Colliery. Accordingly, cognizance was taken against all the aforesaid five accused persons under Section 120B, 409/477 and 477-A I.P.C. and under Section 5(2) read with 5(1)(c) of the P.C. Act 1947. 5. From the record, it transpire that accused Chhota Jodhi Mahato died during the pendency of the trial and proceeding against him was dropped vide order dated 23.2.1991. 6. The prosecution has examined altogether sixteen witnesses to prove its case. They are P.W.1 Ram Dular Tiwary, P.W.2 Gupteshwar Roy, P.W.3 K.K. Karmakar, P.W.4 Baidyanath Tiwary, P.W.5 S.P. Tola Patra, P.W.6 Kulwant Singh, P.W.7 Manik Lal Aich, P.W.8 Bishwanath Chakraborty, P.W.9 Bahadur Ram, P.W.10 Chota Somar Mahato, P.W.11 Ganauri Nonia, P.W.12 A.K. Hargava, P.W.13 Ashok Kumar Rai, P.W.14 Chandrashekhar Pandey, P.W./15 Trilochan Mukherjee and P.W.16 J.P. Verma, the I.O of this case. 7. The prosecution has got exhibited some documents. The defence of the accused persons are the total denial of the charges and their false implication. Defence has also examined only one witness namely Bhaiya Ajay Kumar (D.W.1). 9. The learned counsels appearing for the appellants have submitted that the prosecution case in nutshell that all the appellants (accuse persons) in collusion with the each other misappropriated a huge quantity of detonators, explosives and various types of explosive materials and they are party to a criminal conspiracy. It is submitted that against Chandradeep Singh who is appellant in (Cr. Appeal No. 1338 of 2003) the allegation is that five Depot Transfers (D.T.) were signed by him and all said D.T. were dated 28.5.1985. Since the signature of the Chandradeep Singh were in the said five D.Ts., therefore, it is presumed that explosives were entrusted to him and thereafter as there was no mention in the Stock Register of the Damoda Colliery Magazine regarding receipt of the same as such he has misappropriated the said explosives mentioned in the five D.Ts. In this regard it is mentioned that the evidence P.Ws.1, 5, 6, 8, 10, 11, 15, 16, are important. 11.

It is submitted that though he has proved a number of D.Ts. and also proved signatures of Jodhi Mahto and C.D. Singh but in para 17 of his evidence he has very specially stated that no explosives materials were issued against the aforesaid D.Ts. in his presence even he has no knowledge that in respect of said D.Ts., the management of the said Keshargarh Colliery has made any investigation or not. He has further stated in his evidence in para 26 that he did not make any enquiry that any person receiving any explosives against any D.T., has mentioned the same in the Receipt, Issue and Stock Registers on that particular date. Therefore, it cannot be said that P.W.1 has proved the prosecution case regarding allegation against C.D. Singh that he has received the explosives materials from Keshargarh Colliery Magazine. P.W.6 who was General Manager/Chief Mining Engineer has stated in his evidence regarding the procedure for taking explosives from Keshargarh Colliery to Damoda Colliery. He has further stated that on 28.5.1985 C.D. Singh has received only five D.Ts. and Jodhi Mahto has received rest of the D.Ts. But no where he has stated that on the basis of the said D.Ts., C.D. Singh or Jodhi Mahto received the explosives. P.W.8 Bishwanath Chakravorty who was Magazine Clerk in Kershagarh Colliery in 1985, has stated only that whenever he issued any explosives, the same were usually received by C.D. Singh and Jodhi Mahto. Counsel appearing for C.D. Singh has pointed out this witnesses no where stated any thing about the D.Ts. in question i.e. D.Ts. Dated 28.5.1985. P.W.10 and P.W. 11 were dumper operators responsible for transfer of explosives from Keshargarh Colliery magazine to Damoda Colliery magazine but none of them have stated that any of the appellants was carrying explosives on 28.5.1985 from Keshargarh to Damoda Colliery. He has stated only that Jodhi Mahato used to come Keshargarh Colliery from the Damoda Collieiry to take explosives to Damoda Colliery. P.W.15 Trilochan Mukherjee was Assistant Manager in Damoda Colliery from 1985 to 1987.

P.W.15 Trilochan Mukherjee was Assistant Manager in Damoda Colliery from 1985 to 1987. He has stated in his evidence that in the relevant time A.N. Yadav was Manager of Damoda Colliery and Chandradeep Singh was magazine in-charge and he used to make entry in the Stock Register of Damoda Colliery regarding explosives received from Keshargarh Colliery. He has further submitted that he was not present at Keshargar Colliery Magazine during delivery of explosives in question to Jodhi Mahto. He has further admitted that he does not recognize the handwriting of all the entries except the signature of the C.D. Singh and has further admitted that he has given his statement only after seeing the D.Ts. in question. P.W.16 is J.P. Verma was D.S.P. in C.B.I. from July 1984 to July 1988. He is I.O. of this case. He has proved the F.I.R. (Ext-20) and other Exhibits. Counsel of the appellants have submitted that I.O. has very specifically stated that he never made any physical verification of the Stock of Explosives, Detonators, and Fuses of Keshargar Colliery neither he made any physical verification of Magazine of Damoda Colliery. He has also admitted in his statement that he never checked or seized the Entry and the Exit Register (Gate pass Register) of the vehicle of Keshargarh CISF Camp. He has further admitted he has not investigated that the explosives, detonators, and fuse wires were issued arbitrary or not and further non availability of the explosives in question, the colliery work was ever stopped. 12. It is further submitted that P.W.12 D.S.P., CBI have stated in his cross examination that he has only submitted the charge sheet in this case and P.W.16 has investigated this case. P.W.13 and PW. 14 have proved the death report of Md. Kabir Kirmani who was one of the witness of this case. 13. Counsels appearing in the aforesaid appeals, have submitted that though there is signature of the appellant Chandradeep Singh (C.D. Singh) and Jodhi Mahto alias Chota Jodhi Mahto (died during the pendency of the trial) but there is no evidence either oral or documentary that the said persons had actually received the explosives on the relevant dates from Keshargarh Colliery.
13. Counsels appearing in the aforesaid appeals, have submitted that though there is signature of the appellant Chandradeep Singh (C.D. Singh) and Jodhi Mahto alias Chota Jodhi Mahto (died during the pendency of the trial) but there is no evidence either oral or documentary that the said persons had actually received the explosives on the relevant dates from Keshargarh Colliery. There is no evidence that any vehicle receiving the said explosives from the magazine of Keshargarh Colliery came out from the said Colliery. Even the Log Book of CISF in respect of movement of vehicles carrying explosives from Keshargarh Colliery, have not been brought on record. Furthermore, admittedly there is no stock verification of explosives etc. of Keshargarh Colliery Magazine or of Damoda Colliery Magazine. Therefore, there is no evidence regarding any Physical /actual entrustment of the explosives on the relevant dates to any of the appellants from Keshargarh Colliery. Thus, it can not be said that the appellants have misappropriated as alleged by the prosecution. It is further argued that the whole case is based on presumption as the signatures of the accused appellant C.D. Singh and Jodhi Mahto (deceased) are on the few depot transfers (D.Ts.). 14. Mr. Khan, learned counsel for the C.B.I. has submitted that the allegation against the appellants namely K.P. Singh (Cr.Appeal (S.J).No. 1318 of 2003), A.N. Yadav (Cr. Appeal (S.J) No. 1319 of 2003), Chandradeep Singh (Cr. Appeal (S.J) No. 1338 of 2003 and Ram Nath Pandey (Cr. Appeal (SJ) No. 1299 of 2003 that in collusion with each other, misappropriated a huge quantity of detonators, explosives and various types of explosive materials and being a party to a criminal conspiracy, they received the explosive materials from Keshargarh Colliery Block II, BCCL magazine but the material were not accounted for in the Explosive Stock Register of Domoda Colliery, Area-I, BCCL, Dhanhad. The appellant K.P. Singh and A.N.Yadav placed Depot Transfer (D.T) order by putting their signatures on the D.T. in the indent column for requisition of explosive materials from Keshargarh Colliery. The appellant Ram Nath Pandey issued explosive materials from Keshargarh Colliery which were not accounted for in the Damoda Colliery Stock Register. All the accused persons had played their role in the misappropriation of the explosive materials. 15. After scrutinizing the entire evidence carefully and hearing both the parties, I find except the aforesaid D.Ts.
The appellant Ram Nath Pandey issued explosive materials from Keshargarh Colliery which were not accounted for in the Damoda Colliery Stock Register. All the accused persons had played their role in the misappropriation of the explosive materials. 15. After scrutinizing the entire evidence carefully and hearing both the parties, I find except the aforesaid D.Ts. signed by the appellants concerned, there is no other material which can prove that these appellants on the basis of the aforesaid D.Ts. received explosives and other materials from the Keshargarh Colliery and the same were taken away from the Keshargarh Colliery to the out side. The counsel of the C.B.I. could not point out any evidence in respect of actual receiving of the explosives and other materials on the basis of the aforesaid D.Ts. by the appellants concerned. Furthermore, nothing has come in the evidence that the Stocks of the Keshargarh Magazine were ever verified by the investigating authority neither there is any evidence that explosives and materials mentioned in the aforesaid D.Ts were taken away from the Keshargarh Colliery. Except the aforesaid few D.Ts., there is no materials to prove the charges against any of the appellants. Thus, the prosecution has failed to prove the charges beyond all reasonable doubt against the present appellants. Therefore, giving the benefit of doubt, I allow the appeals i.e. Cr. Appeal No. 1299 of 2003, Cr. Appeal No.1319 of 2003 and Cr. Appeal No. 1338 of 2003 and set aside the Judgment of conviction and sentence dated 25.08.2003 passed by the Ist Additional Sessions Judge, Cum-Special Judge, C.B.I., Dhanbad in R.C. No. 21(A) of 1986(D). As the appellants are on bail, they are discharged from the liability of the bail bonds. 16. In the Cr .Appeal No. 1318 of 2003, it has come on the record that during the pendency of the appeal, the appellant namely K.P. Singh died. Therefore, the said appeal has become infractuous. Accordingly, the said Cr. Appeal No. 1318 of 2003 is dismissed as infractuous.
