Judgment :- 1. The petitioner prays for issuance of a writ in the nature of mandamus, to direct the respondent to appoint the petitioner as Office Assistant in the existing vacancy available at Nangavalli Panchayat Union. 2. The prayer itself is not competent, as this Court cannot issue direction for appointment of a person against available vacancy, but can only direct to consider the case of the petitioner, in case he/she is eligible for appointment that too when the posts are being filled up by regular process. The pleading in this case do not show that any steps were taken by the respondents to fill up the posts of Office Assistant, against which the petitioner claims the right of consideration. No merit, dismissed. No costs.
