JUDGMENT 1. - The instant miscellaneous petition has been filed by the petitioner seeking a direction for fair investigation of F.I.R. No. 77/2012, registered at the Police Station, Thanwla, Distt. Naguar for the offences under Sections 143, 323, 447, I.P.C. and Section 3(1)(x) of the SC/ST (Prevention of Atrocities) Act cases. 2. Upon having considered the arguments advanced by the learned counsel for the petitioner and after going through the F.I.R. and the other material available on record. This evident that the petitioner has approached this Court without first making a request to the concerned Magistrate for calling the progress report from the police and without requesting the Magistrate to direct fair investigation in the matter. This Court in S.B. Crl. Misc. Petition No. 1810/2012, Dhura Ram v. State of Rajasthan, decided on 27.7.2012 whilst considering the judgment of the Apex Court in the case of Sakiri Vasu v. State of U.P., reported in AIR 2008 SC 907 , has directed the aggrieved person to first approach the concerned Magistrate and raise his grievance before the Magistrate who can direct the police to make a proper and fair investigation in the matter after calling a report himself. 3. The grievance of the learned counsel for the petitioner is that despite the direction issued by the Hon'ble Apex Court in the case of Sakiri Vasii referred supra the concerned Magistrates are not paying heed to the law laid down by the Apex Court in the aforesaid judgment and the applications filed in this regard -are being reported with bare formality and no effective steps are being taken by the Magistrates. 4. In view of the aforesaid grievance it is hereby directed that whenever any application for calling a report of the investigation and for ensuring the proper investigation is filed before the concerned Magistrate who is seized of the F.I.R. the concerned Magistrate shall examine the same on merits and thereafter exercise powers for directing a fair investigation if so warranted as per the guidelines laid down by the Apex Court in the case of Sakiri Vasil (supra).The miscellaneous petition disposed of accordingly by giving liberty to the petitioner to approach the concerned Magistrate by way of an application seeking a direction for fair investigation.Petition disposed of. *******
