JUDGMENT Learned counsel Mr. Rajeev Kumar submitted that the employees of the Jharkhand State Electricity Board (in short “J.S.E.B.) have declared strike and because of that reason some of the areas of the State of Jharkhand have no power supply including the Capital City. 2. News to this effect has been published in various newspaper, copy of which has been shown to us. The matter requires serious consideration that whether such an indispensable service depends upon the J.S.E.B. Union's decision of going on strike. We may recapitulate here that earlier some doctors went on strike and it has been reported in various newspaper that number of patients died. In another matter, the strike was called by the employees of the RINPAS and in that matter also Court took cognizance and registered the Public Interest Litigation. 3. If the doctors in the hospitals are available and the facilities are available, which may be in General Hospital, Private Hospital or hospital like RINPAS, even then they may not be able to do any work and the patients may die, due to non-supply of power. Not only this, this power supply may also create the problems in Court's working. This disruption of power supply may also result into disruption of the water supply in the various part of the State of Jharkhand. 4. Therefore, without waiting for any response from the Union of the J.S.E.B., we are directing the State Government as well as the Chief Secretary, State of Jharkhand and J.S.E.B., and particularly the Chairman, J.S.E.B to take remedial measure immediately. Learned Advocate General is requested to assist the Court and Office is directed to list the matter tomorrow i.e., on 7th December, 2012 on the top of the list as first case. 5. Copy of this order may be given to learned Advocate General, who will be assisting the Court as Amicus Curiae. Copy of this order may also be sent to Chief Secretary, State of Jharkhand; the Chairman, J.S.E.B and also to the Union of J.S.E.B and if there are more than one Union of J.S.E.B, copy of the order may also be served upon them. Copy of Newspapers are taken on record. 6. Put up on 7th December, 2012 on the top of the list.
