JUDGMENT 1. - Heard learned counsel for the parties and with their assistance perused the material made available during arguments. 2. Counsel for petitioner submits that contraband recovered from the possession of the accused petitioner is less than commercial quantity and charge-sheet has been filed and no further recovery is to be made from him and there is no case of such like nature either registered or pending against the accused petitioner. 3. Learned Public Prosecutor opposed the bail application. 4. Taking note of nature of the alleged accusation but without expressing any opinion on merits, this Court considers it appropriate to allow this post-arrest bail application of accused petitioner U/s 439 Cr.P.C. 5. Accordingly applicant ( Mahendra Kumar Kharra ) be released on post-arrest bail U/s 439 Cr.P.C. in FIR-36/2012 registered at Police Station Khatushyamji, District Sikar for offences alleged provided he furnishes CRLMB-7521/12 (2) personal bond in a sum of Rs. 50,000/- with two sureties each for Rs. 25,000/- to the satisfaction of trial court for his appearance before that court on subsequent dates, whenever called upon to do so and will further furnish correct residential address along with contact number & so also change if any takes place, to the trial court.Bail application allowed. *******
