JUDGMENT Mrs. Sabina, J.: - This petition has been filed under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail in case FIR No. 315 dated 20.8.2012, under Sections 420 and 120-B of the Indian Penal Code, 1860 at Police Station (EOC Cell), Sector 17 Chandigarh. 2. While issuing notice of motion, the following order was passed by this Court on 16.10.2012 :- “Notice of motion for 9.11.2012. List along with CRM-M No.32442 of 2012. In the meantime, in the event of arrest, the petitioners be admitted to interim bail subject to the satisfaction of the Arresting Officer. They shall abide by the conditions envisaged under Section 438 (2) of the Code of Criminal Procedure, 1973.” 3. Learned counsel for the petitioners has submitted that the dispute between the parties was purely civil in nature. It was the case of the complainant that certain medicines had been supplied by it to the petitioners but payment had not been made qua the same. In fact, cheques had been issued by the petitioners in favour of the complainant and no complaint under the Negotiable Instruments Act, 1881 had been filed with regard to dishonour of cheques. 4. Learned counsel for the Administration, who is assisted by learned counsel for the complainant, on instructions from Sub Inspector Surender Kumar, has submitted that the petitioners have joined investigation in terms of the order reproduced above but recovery of the amount in question was yet to be effected. 5. In the present case, there is a money dispute between the parties and since the petitioners have joined investigation, it would be just and expedient to confirm the interim bail already granted to the petitioners. 6. Accordingly, without expressing any opinion on the merits of the case, this petition is allowed and the order granting interim bail dated 16.10.2012 is made absolute.
