Judgment :- D. MURUGESAN, J. 1. The petitioner has questioned the order passed by the learned Chief Judicial Magistrate, Chengalpattu on a petition filed by the first respondent-Bank under Section 14 of the SARFAESI Act. Though we are not inclined to interfere with the same, having regard to the fact that the petitioner is ready and willing to pay the entire balance amount, which is around Rs.60 lakhs, within a period of eight weeks. We post this matter on 10.4.12 to enable the petitioner to file affidavit to that effect. 2. The Registry is directed to list this case on 10.4.2012 under the caption “for orders”. On that day, the petitioner should file an affidavit of undertaking to the effect that she shall pay the abovesaid amount within a period of eight weeks. 3. The learned counsel appearing for the petitioner has submitted that some of the medical records are now lying in the ground floor of the premises and those records are urgently needed for the petitioner to take treatment. 4. The first respondent-Bank shall allow the petitioner to take only the medical records pertaining to the petitioner, by name G. Saraswathi, wife of Govindarajulu, who is aged about 78 years in the presence of the Advocate Commissioner. The above direction is only for a limited purpose of removing the documents and it shall not be construed to mean that the petitioner shall take possession of the said premises.
