JUDGMENT 1. - Heard learned counsel for the petitioner, learned Public Prosecutor for the State and perused the relevant documents placed before me. 2. Contention of the learned counsel for the petitioner is that that there is civil transaction between the parties. The petitioner has borrowed a sum of Rs. 8,00,000 from the complainant and re-paid a sum of Rs. 9,50,000 inclusive of interest and remaining amount of Rs. 65,950/- was yet to be paid. When the petitioner borrowed the money, he had given a signed cheque of Rs. 8,00,000 as security. Initially the complainant in statement under Section 161 of Cr.P.C. to the police agreed that the papers containing the account of payment and receipt of the money was prepared by him in which Rs. 9,50,000 was shown to be received and Rs. 65,950/- was yet to be paid by the petitioner. At that stage even the police proposed to file the final report but subsequently at the instance of complainant, investigation was changed and now the police wants to arrest the petitioner. 3. Learned Public Prosecutor has though opposed the bail application, but could not deny the fact that initially the police proposed to give final report in the matter. He also argued that the case for offence under section 138 of Negotiable Instruments Act is also said to be pending against the petitioner at the instance of complainant. 4. Having regard to the submissions made at the bar, the nature of accusation against the petitioner, the materials collected so far during the course of investigation and all other facts and circumstances of the case, I deem it just and proper to grant the indulgence of pre-arrest bail to the petitioner. 5. In the result, this bail application u/S.438 Cr.P.C. is allowed and it is directed that in the event of arrest of petitioner Krishan Kumar Chandal S/o Late Shri Suwa Lal in FIR No.404/2011, P.S. Kardhani, Jaipur City (South) for offences under Sections 420, 468 and 471 of IPC, he shall be released on bail by the concerned SHO/Investigating Officer, provided he furnishes a personal bond in the sum of Rs. 50,000/- with two sureties of Rs.
50,000/- with two sureties of Rs. 25,000/- each to his satisfaction on the following conditions:- (1) that the petitioner shall make himself available for interrogation by a police officer as and when required; (2) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer; and (3) that the petitioner shall not leave India without previous permission of the Court.
