JUDGMENT Mr. Ram Chand Gupta, J.(Oral) - CRM No.74984 of 2012 Application is allowed subject to all just exceptions. CRM No.74983 of 2012 Requests for placing on record copy of Criminal Misc. No. M-30186 of 2012 filed by petitioner in case FIR No.68 dated 1.9.2012, registered under Sections 420, 467, 468, 471 and 120-B of Indian Penal Code, registered at Police Station Bhadson, District Patiala. The same is taken on record subject to all just exceptions. Criminal misc. stands disposed of. CRM M-32467 of 2012 1. This is an application for regular bail filed under Section 439 of the Code of Criminal Procedure in FIR No.68 dated 1.9.2012, registered under Sections 420, 467, 468, 471 and 120-B of Indian Penal Code, registered at Police Station Bhadson, District Patiala. 2. I have heard learned counsel for the parties and gone through the record. 3. It has been argued by learned counsel for the petitioner that he had already filed civil suit for specific performance of the agreement executed between the petitioner and the complainant and that the present FIR was lodged by the complainant after receiving notice in the said civil suit. Further contended that petitioner has been continuing in custody since 4.9.2012 and that investigation completed and challan filed. It is further contended that the case which is triable by Magistrate, is not likely to be concluded in near future. 4. Learned counsel for the State has not disputed these facts. 5. There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. 6. Hence, keeping in view these facts and without expressing any opinion on merits, the instant application for regular bail filed on behalf of petitioner Rashwinder Singh is allowed. 7.
