ORDER : Dinesh Kumar Singh, J. Heard learned Counsel for the petitioner and the State. The petitioner being the husband is apprehending his arrest in a case registered u/s 498A of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act. The marriage was performed on 11.6.2010, the divorce case was filed on 23.10.2010 when the present case was filed on 5.12.2010. It appears from the report of mediation centre, at Flag 'A' that the mediation has failed. In the circumstances, the petitioner is ready to pay Rs. 5,000 per month to the wife from March, 2012 by depositing the same in the bank account of the wife by second week of every month. 2. The wife accepts the aforesaid offer of the petitioner and undertakes to supply her bank account number to the petitioner within a period of three weeks by filing the same on affidavit before the learned Court below. The present arrangement is being made in anticipation of lurking hope that the parties may reconcile in future. 3. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing the bail bond of Rs. 10,000 (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Jamalpur P.S. Case No. 133 of 2010 subject to the conditions as laid down u/s 438(2) of the Cr.P.C. Three consecutive defaults in making payment by the petitioner will give liberty to the wife to file an application for cancellation of bail of the petitioner.
