Judgment :- 1. Writ Petition is filed praying to issue a Writ of Mandamus, directing the respondent to renew lease agreement for period of another three years from 1.4.2011 to 31.3.3014 in respect of pay and use toilet situated at old bus stand, Calicut Road, Gudalur. 2. Mr.R.Vijayakumar, learned Additional Government Pleader takes notice on behalf of the respondent. By consent, the writ petition is taken up for final disposal. 3. Petitioner has already approached the Civil Court and obtained a decree in O.S.No.39 of 2008 on the file of District Munsif Court, Gudalur. The present writ petition has been filed for a mandamus to renew the lease agreement for the period of three years from 1.4.2011 to 31.3.2014 in respect of pay and use toilet. 4. In view of the Civil Court order, petitioner has failed to explain as to how the present writ petition is maintainable. Insofar as the present writ petition is concerned, no mandamus would lie as admittedly, the petitioner has not made any request for renewal of lease agreement. Therefore, this Court is not inclined to entertain the writ petition only on the ground that the petitioner failed to approach the respondent for renewal of lease agreement. No cause of action arises for filing this writ petition. 5. In the result, this Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
