JUDGMENT Sudhir Agarwal,J. 1. List revised. None appeared on behalf of petitioner. However, I have perused the record. 2. This writ petition is directed against the order dated 07.10.2003 passed by Rent Control and Eviction Officer, Kanpur Nagar declaring a vacancy at first floor of House No. 13/151 situated at Parmat Kanpur and the release order dated 31.10.2003 releasing accommodation in question in favour of landlord 3. The petitioner has been found to be unauthorized occupant of premises in question. In view of reference made to Larger Bench and answered by Division Bench vide order dated 05.02.2008 in Writ Petition No. 37767 of 2003, Ajay Pal Singh Vs. District Judge, Meerut and others, the petitioner cannot challenge the release application of landlord being an unauthorized occupant of premises in question. 4. In view thereof, no interference is called for with the orders impugned in this writ petition. The writ petition is accordingly dismissed. Interim order, if any, stands vacated.
