JUDGMENT 1. - Application for early listing is allowed. 1. With the consent of counsel for parties, this writ petition is heard finally. 2. The petitioner was appointed on the post of Constable. She made an application for study leave to undertake B.Ed. Course. The leave application was rejected by the respondents vide order dated 26.04.2012. 3. Learned Counsel for petitioner submits that petitioner is even ready to take leave without wages to undertake on year B.Ed. Course, thus, respondents be directed to consider her case for the aforesaid leave. 4. Counsel for respondents submits that as per circular dated 3rd October, 2007, study leave can be granted only if an employee wants to undertake study of the course which can advance his efficiency to the post on which he is working. The petitioner intends to undertake B.Ed. Course while she is in police service, thus, appropriate authority did not find it proper to grant study leave. However, her case can be considered for grant of leave without wages. 5. I have considered the rival submissions of the parties and perused the record. 6. The petitioner applied for study leave which has been refused in view of circular dated 3rd October, 2007. It is no doubt the petitioner is not going for the study which may advance her efficiency on the post on which she is working. Thus, denial of study leave by the respondents cannot be said to be illegal. The petitioner is however ready to seek leave without wages to undertake study of one year course. 7. Looking to the changed circumstances and prayer made, this writ petition is disposed of with the liberty to the petitioner to make an application for leave without wages and if such application is moved, respondents are directed to consider the same as leave without wages will not cause any financial loss to the respondents, thus, consideration would be made objectively and sympathetically as and when application for leave without wages is moved by petitioner. 8. With the aforesaid, writ petition so as the stay application stand disposed of.Writ Petition and Stay Application Disposed of as above. *******
