JUDGMENT 1. - This anticipatory bail application has been filed by the petitioners apprehending their arrest in connection with F.I.R. No.239/2012 registered at P.S. Kesharisinghpur, District Sri Ganganagar for the offences under Sections 498A and 406 IPC. 2. Heard learned counsel for the petitioner and learned public prosecutor as well as learned counsel for the complainant and perused the record. 3. The petitioners are respectively the father-in-law and mother-in-law of Mst. Jaskrit Kaur who was married with the petitioners son Abhayjeet Singh on 29.01.2007. The FIR has been filed in this case by the brother of Mst. Jaskrit Kaur and in the FIR, there is no allegation regarding any harassment being given out by the petitioners to Mst.Jaskrit Kaur on count of bringing less dowry. No list of dowry articles was filed along with the FIR. Subsequently, Mst. Jaskrit Kaur in her statement under Section 161 Cr.P.C. has given a wavering statements regarding the alleged exchange of 101 gold mohars. This Court is of the opinion that the statement of Jaskrit Kaur regarding the 101 gold mohars is of an uncertain nature. No proof of purchase or procurement of the said 101 gold mohars, value whereof could be nearing Rs. 30 lakhs, has been filed on record during the investigation. 4. Having regard to the overall facts and circumstances of the case, but without expressing anything on the merit of the case, this Court is of the opinion that it is a fit case for grant of anticipatory bail to the petitioners under Section 438 Cr.P.C. 5. Accordingly, this bail application is allowed and it is directed that in the event of arrest of petitioners (1) Ralvindarjeet Singh and (2) Smt.Jaspal Kaur in connection with F.I.R. No.239/2012 registered at P.S. Kesharisinghpur, District Sri Ganganagar, the petitioners shall be released on bail; provided they furnishes a personal bond in the sum of Rs. 50,000/- each along with two sureties of Rs.
50,000/- each along with two sureties of Rs. 25,000/- each to the satisfaction of the concerned Investigating Officer/S.H.O. on the following conditions: (1) that the petitioners shall make themselves available for interrogation by a police officer as and when required: (ii) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer; and (iii) that the petitioners shall not leave India without previous permission of the court. *******
