Judgment :- 1. The petitioner has filed the Writ of Mandamus praying for an issuance of an order by this Court in directing the second and third respondents to include his name in the list for written examination to be conducted on 29.10.2006 and subsequent dates for the post of Assistant Engineer in the second respondent office/Chennai Metropolitan Water Supply and Sewerage Board, Chennai. 2. The Learned Counsel for the second respondent/Chennai Metropolitan Water Supply and Sewerage Board, Chennai brings it to the notice of this Court that the petitioner was permitted to attend the written test pursuant to an interim direction issued thereto, that the cut-off marks fixed by the second respondent Board for SC category was 53.80% and since the petitioner's score is less than the cut-off mark prescribed, he was not called for an oral interview and further selection process. As a matter of fact, the interview and selection process were over on 05.02.2007 and the selected candidates were appointed as Assistant Engineers. Moreover, the lowest mark scored by the last selected SC candidate was 66.68%. As on date, nothing survives for adjudication in the present writ petition. 3. In view of the fact that the writ petition has become infructuous, this Court dismisses the Writ Petition as an infructuous one. Consequently, connected Miscellaneous Petition is also closed. No costs.
