JUDGMENT:- 1. Writ Petition is filed praying to issue a Writ of Mandamus, to direct the first respondent to adjust a sum equivalent to the seigniorage fees collected by the Government from persons permitted to quarry for road materials in the land situated within the territory of Kandikuppam Village Panchayat to the Kandikuppm Village Panchayat funds within the time stipulated by this Court, in future permit the petitioner to collect seigniorage fee or dead rent as per rule 36(5)(bb) and proviso to Rule 36-B of the Tamilnadu Minor Mineral Concession Rules, 1959 from persons permitted to quarry for road materials in the land situated within the territory of Kandikuppan Village Panchayat. 2. Ms. V.M. Velumani, learned Special Government Pleader takes notice on behalf of the respondents. By consent, the writ petition is taken up for final disposal. 3. Petitioner states that the seigniorage fee that is collected has been apportioned in favour of the ninth respondent to the detriment of the petitioner. In this regard, a representation has been given on 27.3.2012 and another representation on 14.5.2012. 4. In view of the above, the District Collector is directed to consider the representations of the petitioner dated 27.3.2012 and 14.5.2012 after affording the petitioner a personal hearing and decide the issue on merits and in accordance with law expeditiously, preferably, within a period of twelve weeks from the date of receipt of a copy of this order. 5. The writ petition is disposed of as above. No costs. Consequently, connected miscellaneous petition is closed.
