Shabihul Hasnain, J.— Heard Sri Mohd. Ali, learned counsel for the petitioners, Sri L.J. Maurya for opposite parties no. 4 and 5 and the learned A.C.S.C. for the State. The petitioners are aggrieved by non payment of salary since February, 2012. The case of the petitioners are that they were initially appointed on contract basis but later on, vide order dated 1.9.2009 their services were regularized on the post of sweeper. The regularization order has been annexed with the writ petition. Petitioners continued to work on the said post without interruption and they have been paid salary till February, 2012. Thereafter, the District Magistrate has passed an order on 30.5.2012 as contained in annexure no. 13 at page-68, to the writ petition. In this order, the District Magistrate has constituted a committee of three members to inquire into the regularization process, which is said to have been made in violation of relevant Govt. orders. The District Magistrate has not passed any order for stopping salary of the petitioners. It has been informed that the order specifically mentions that the inquiry should be completed within three days. It has further been informed that the committee has not submitted its recommendation after inquiry till date. However, the salary of the petitioners have been stopped since February, 2012. There is no order of cancellation of regularization or termination of the services of the petitioners. Even the inquiry report has not been submitted to the District Magistrate. There is no order of stoppage of salary. In such a situation, non payment of salary of the petitioner is totally, illegal, malafide, unreasonable and without any basis. Thus, the action of the opposite parties are totally arbitrary. The petitioners are low paid employees and non payment of salary will bring them on the verge of starvation. Such a situation cannot be allowed by this Court. Accordingly, the opposite parties are directed to resume payment of salary immediately to the petitioners. However, opposite parties will be at liberty to take any action in accordance with law and due process. With these observation and direction, this writ petition stands finally disposed of. _____________
