Het Singh Yadav, J.;— The present Writ Petition has been filed by the petitioner, inter-alia, praying for directing the respondents-authority to provide an alternative Plot to the petitioner on the same terms and conditions under which he was allotted the Plot in Vaishali-I Scheme in the Year 1992. We have heard Shri H.R. Mishra, learned Senior Counsel assisted by Shri Abhishek Mishra, learned counsel for the petitioner, the learned Standing Counsel appearing for the respondent no.1 and Shri Shivam Yadav, learned counsel for the respondent nos.2 and 3. Shri Shivam Yadav, learned counsel for the respondent nos.2 and 3 submits that the petitioner has already approached the Consumer Disputes Redressal Forum, Ghaziabad in the Year 2002 seeking similar reliefs. The matter is still pending before the Consumers Disputes Redressal Forum, Ghaziabad. He brings to our notice, Complaint filed before the Consumer Disputes Redressal Forum, Ghaziabad, copy whereof has been filed as Annexure 10 to the Writ Petition. It is, thus, evident that the petitioner is already availing remedy before the Consumer Disputes Redressal Forum, Ghaziabad for redressal of his alleged grievances as raised in the present Writ Petition. In the circumstances, we are not inclined to exercise our Writ Jurisdiction under Article 226 of the Constitution of India in the present case. The present Writ Petition filed by the petitioner is liable to be dismissed on the ground that the petitioner is already availing remedy before the Consumer Disputes Redressal Forum, Ghaziabad, and the same is accordingly dismissed on the said ground. _____________
