Judgment :- 1. Animadverting upon the order dated 23.11.2011, passed in CMP No.1213 of 2011 in A.S.No.301 of 2011 by the learned IV Additional Judge, City Civil Court, Chennai, this civil revision petition is focussed. 2. Heard the learned counsel for the petitioner. 3. Despite printing the name of the respondent, no one appeared on his behalf. 4. The learned counsel for the petitioner would echo the cri de coeur of his client to the effect, that as a plaintiff he obtained a decree in the trial Court, as against which the respondent herein preferred appeal. He filed CMP No.1213 of 2011 seeking stay; whereupon, the lower Court ordered thus: "In the result the petition is hereby allowed with the condition that the petitioner/appellant have to deposit a sum of Rs.15,450/- into the court deposit within 15 days and the amount have to be kept in court deposit till the disposal of this appeal and the stay of operation of the judgment and decree of the trial Court is hereby granted. However no cost." 5. Being aggrieved by and dissatisfied with the said order, this revision has been focussed on various grounds. 6. This Court wanted to ascertain from the learned counsel for the revision petitioner, as to whether any application has been filed before the lower Court for withdrawal of the amount representing the cost referred to supra, for which, the learned counsel for the petitioner would reply that, since the order was to the effect that the said amount should be kept in the Court deposit till disposal of the appeal, he had not petitioned the Court for withdrawal. I hereby give liberty to the petitioner to file necessary petition before the appellate forum for withdrawal; whereupon it is for the appellate Court to pass suitable orders after hearing both sides. Accordingly, this petition is disposed of. No costs. Consequently connected miscellaneous petition is closed.
