JUDGMENT : Learned counsel for the petitioner submits that only relief (d) is being pressed at this stage. As regards other reliefs are concerned, writ petition is not being pressed. It appears that process under Sections 82 Cr.P.C. was executed against the petitioner; thereafter proceedings under Section 83 Cr.P.C. have been ordered against him. Learned Additional Standing Counsel submits that the proceedings under Section 83 Cr.P.C. had to be initiated since petitioner was not found at the given address nor was traceable. As against this, learned counsel submits that the petitioner had not been absconding and was very much available in Delhi. Petitioner had shifted his residence from B-38, Greater Kailash I, New Delhi to a Farm house bearing number 6-A, Gadaipur, Gobind Sadan Road. Mehrauli, New Delhi -110030. Had the Investigating Officer made efforts he could have traced the address of petitioner. No notices/summons had been served on the petitioner at the earlier address since he was not residing there, therefore, he could not respond to such notices, since Learned Additional Standing Counsel submits that the petitioner has now joined the investigations and has also provided his new address. In these facts, proceedings under Section 82/83 Cr.P.C. against the petitioner are quashed. Writ petition is disposed of in the above terms. Crl.
