Judgment :- 1. These two writ petitions have been filed to direct the respondents 1 and 2 to consider representations of the petitioners dated 28.7.1999, 3.5.2002 and 28.7.99 & 15.7.2002 respectively and conduct proper enquiry and issue a patta in petitioner favour. 2. These two writ petitions are filed for a direction to consider the representation and to conduct proper enquiry and issue patta in favour of the petitioners. The writ petitions were admitted and notices were issued. The 5th respondent filed a counter affidavit for and on behalf of the respondents 3 to 6 stating that the claim of the petitioners is false and civil suits are pending and the writ petitions are filed suppressing the material facts. The 5th respondent has filed a detailed affidavit stating as to how the claim of the petitioners is false and has also referred to various partition deeds and settlement deeds. At the time of final hearing, the learned counsel for the petitioners fairly states that C.S.No. 848 of 2007 filed for partition is pending before this Court. 3. In such circumstances, this Court is not inclined to direct the authority/ respondent to consider the representations in view of the disputes between the parties and the pendency of the suit in C.S.No. 848 of 2007. Hence, both the writ petitions are dismissed. No costs.
