Judgment :- 1. Animadverting upon the order dated 06.09.2011 passed in I.A.No.286 of 2011 in O.S.No.167 of 2010, by the learned District Munsif at Gudiyattam, Vellore District, this civil revision petition is focussed. 2. A thumbnail sketch of the germane facts absolutely necessary for the disposal of this revision petition would run thus: The revision petitioner herein being the plaintiff, filed the suit for permanent injunction. During the pendency of the suit, I.A.No.488 of 2010 was filed to get a Commissioner appointed to visit the property and note the physical features. The Commissioner submitted his report after executing the Commissioner warrant. However, the plaintiff had not filed objection within the time stipulated by the Court; whereupon I.A.No.286 of 2011 was filed seeking permission to file objection, but it was dismissed. 3. Being aggrieved by and dissatisfied with the said order of dismissal, this revision is focussed. 4. The learned counsel for the petitioner/plaintiff, placing reliance on the grounds of revision, would submit that the expectation of the lower Court that the delay in filing the objection should have been explained meticulously was untenable and even in the affidavit accompanying the I.A. the plaintiff detailed and delineated about his ill health having the cause for not filing the objection in time. 5. I am of the view that when the suit is pending, the objection to the Commissioner's report could be filed at any time, but it should be filed within a reasonable time so that the other side would be in a position to concentrate on that and the Court also would be in a position to pass further direction on that objection. As such, I am of the view that the delay could be condoned and accordingly it is condoned. In the result, the civil revision petition stands allowed. No costs. Consequently connected miscellaneous petition is closed.
