Judgment :- VINOD K.SHARMA, J. 1 The learned counsel for the petitioner states that the impugned order is appealable under Sec.11 of the Passport Act, 1967. 2 In view of the availability of the alternative remedy of statutory appeal, the learned counsel for the petitioner prays for liberty of this Court to withdraw the writ petition so as to avail statutory remedy of appeal. 3 The learned counsel for the petitioner prays that liberty be granted to the petitioner now to file the appeal within 30 days of receipt of certified copy of this order, as the limitation prescribed under the Act expired during the pendency of the writ in this Court. 4 The prayer is allowed. The writ petition is ordered to be dismissed as withdrawn, with liberty to file statutory appeal. 5 In case, the petitioner prefers an appeal, within 30 days of receipt of certified copy of this order, shall be treated to have been filed within limitation, and the appeal be decided on merit, and in accordance with law. No cost.
