2012-12-13

HET SINGH YADAV, SATYA POOT MEHROTRA

body2012
Het Singh Yadav, J.;— It appears that an advertisement dated 20.12.2010 was published by Indian Oil Corporation Limited inviting applications from the candidates seeking appointment as Retail Outlet Dealers under Kisan Seva Kendra Scheme of the Government. The petitioner and other persons submitted their applications, pursuant to the said advertisement. The result in regard to the selection for appointment as Retail Outlet Dealer under the said Scheme was published on 12.10.2011 by Indian Oil Corporation Limited whereby the respondent no. 4 was selected for grant of Retail Outlet Dealership in respect of the Kisan Seva Kendra in question. Complaint was made by the petitioner and other persons in respect of the said selection. By the order dated 28.5.2012, the respondent no. 2 found certain objections raised in the complaint made by the petitioner and other persons to be correct, and accordingly, directed for Re-evaluation of document related marks of all candidates who attended the interview. As nothing was done in respect of Re-evaluation, the petitioner has filed the present Writ Petition, inter-alia, praying that the respondent no. 2 be directed to finalize the process of Re-evaluation of marks in pursuance of the said order dated 28.5.2012, and communicate the result thereof to the petitioner within such time as may be fixed by the Court. We have heard Sri Kshitij Shailendra, learned counsel for the petitioner, and Sri Prakash Padia, learned counsel for the respondent nos. 1 and 2, and perused the record. Sri Prakash Padia, learned counsel for the respondent nos. 1 and 2, on the basis of instructions received by him, states that Re-evaluation of marks in pursuance of the said order dated 28.5.2012 has been done, and communication dated 24/27.11.2012 has been issued in this regard. Sri Prakash Padia has handed over copy of the said communication dated 24/27.11.2012 to Sri Kshitij Shailendra, learned counsel for the petitioner. In view of this, it is evident that the prayer made by the petitioner in the present Writ Petition stands granted. No further orders are, therefore, required to be passed in the present Writ Petition. The Writ Petition stands disposed of accordingly. _____________
