ORDER Heard Shri Krishna Prasad Singh, learned Senior Counsel for the petitioner and Shri Binod Kumar, learned Additional Public Prosecutor. 2. This is the peculiar case in which the petitioner, who was accused in an offence for committing dacoity in a Post Office, has come for quashing of an order of cognizance, which was passed long back on 26.4.2002. While assailing the order, the petitioner has brought on record some truncated order sheet of the court below. 3. Perusal of the said order sheet makes it clear that in the year 2008, the learned court below had directed for issuance of non bailable warrant of arrest. Nothing has been asserted as to whether the petitioner has surrendered or not. It has further been pleaded that the petitioner though was put on T.I.Parade, was not identified by any of the witnesses. In the F.I.R., there is specific case of informant, who is none else but Sub Postmaster, Madhepura where dacoity was committed that accused persons had wrapped their faces and necks by Mufler. 4. In view of the fact that the accused persons had wrapped their face at the time of committing dacoity, one cannot come to a definite conclusion that in such cases, identification in Test Identification was must. In criminal cases, there are other circumstances also to show involvement of the accused persons. In any event, police, after investigation, had submitted charge sheet against the petitioner and others and thereafter, cognizance order was passed in the year 2002. 5. In view of the facts and circumstances, I do not find any material to entertain the present petition. However, keeping in view the fact that non bailable warrant of arrest was issued for securing attendance of accused persons while dismissing the petition, it is desirable to direct the concerned Superintendent of Police i.e. Superintendent of Police, Madhepura to take all steps for execution of non bailable warrant of arrest against the accused persons so that trial may commence without any delay and come to its logical end, if N.B.W.A. has not been executed till date. 6. With above observation and direction, the petition stands dismissed. 7. Let a copy of this order be sent to the Superintendent of Police, Madhepura as well as to the court below forthwith.
