Judgment :- 1. This civil revision petition has been focussed so as to direct the learned District Consumer Disputes Redressal Forum, Puducherry to keep the execution proceedings in E.P.No.16 of 2010 in abeyance till the disposal of the appeal filed before the State Commission against the orders of District Consumer Disputes Redressal Forum, Puducherry dated 27.07.2010 on merits. 2. Heard the learned counsel for the petitioner, who would narrate the facts to the effect that the District Consumer Disputes Redressal Forum, Puducherry passed orders, as against which, appeal was filed before the State Commission with an application to get the delay condoned. However, the said application is pending because, the Chairman/ the Judicial Member post is vacant. Hence, the petitioner is constrained to filed this revision under Article 227 of the Constitution of India. 3. I would like to clarify that it is not open for the aggrieved party, viz., the revision petitioner to file this revision under Article 227 of the Constitution of India, to get stay of the order passed by the District Forum. The only remedy, if at all available for the revision petitioner is to approach this court under Article 226 of the Constitution of India citing the Pondicherry Government also as one of the respondents and seek suitable direction in that regard. 4. With the above direction, this civil revision petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
