BHAGWATI, J.—Heard on application No. 1151 dated 11th January, 2012 filed under Section 5 of the Limitation Act, wherein the appellant has implored to condone the delay of 200 days in filing the appeal. 2. Having heard the learned counsel for the appellant and carefully perused the relevant material on record, it is noticed that the Commissioner, Workman's Compensation, Jaipur District-II, Jaipur, adjudicated the claim petition filed by the appellant and decreed an amount of Rs. 1,04,821/- in favour of the appellant and against the respondents along with the interest at the rate of 12% to be paid thereon, from the date of filing the claim petition. 3. Learned counsel for the appellant canvassed that the appellant was not in the know of the legal provision that the appeal was required to be filed within a period of 60 days. He came to know about this fact only when he endeavoured to contact his counsel. 4. It is relevant to record that the appellant is required to explain these 200 days' delay in filing the appeal. The appellant was required to appeal within 60 days, whereas he has filed the same after the expiry of 200 days from the expiry of period of limitation. Learned counsel for the appellant has utterly failed to explain the delay reasonably and satisfactorily. Hence, the application filed under Section 5 of the Limitation Act being devoid of any substance deserves to be dismissed and thus, stands dismissed, accordingly. 5. There is one more application No. 1152 dated 11th January, 2012, which is with regard to taking the documents on record. Since, the application under Section 5 of the Limitation Act has been dismissed, hence, this application also stands dismissed, accordingly. 6. Consequent upon the dismissal of the application under Section 5 of the Limitation Act, the appeal does not survive and the same also stands dismissed.
