JUDGMENT Rakesh Kumar Garg, J 1. Present petition has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of habeas corpus directing the respondent No.4-Gurmej Singh to release the detenue namely Baljit Kaur, who is alleged to be the wife of the petitioner. 2. It is stated that Baljit Kaur has been confined in the illegal custody of her father, respondent No.4, against her wishes. 3. Today, Baljit Kaur, the alleged detenue, is present in Court along with her father-respondent No.4. 4. Baljit Kaur has stated before this Court that she is residing with her father according to her own accord and free will and intends to reside with him only. She has refuted the averments made in this petition with regard to her marriage with the petitioner. 5. Gurmej Singh-father of Baljit Kaur has produced before this Court a photostat copy of certificate dated 26.8.2011 issued by the Government Elementary School, Cheema Khurd, Amritsar, according to which, the date of birth of Baljit Kaur, the alleged detenue, is 11.4.1998 i.e. just about 14 years. 6. The aforesaid facts are sufficient to falsify the case of the petitiioner and to dismiss the instant writ petition. 7. Ordered accordingly. Petition dismissed.
