Hon'ble GUPTA, J.—This appeal has been filed under Section 173 of the Motor Vehicles Act for enhancement against the award dated 13.7.2000 passed in MAC No. 252/1999. 2. The brief facts of the case according to claim petition are that on 11.6.1999, Shri Surendra Singh was going on a scooter and near Morinda Bus Stand, Jeep No. RJ-18C-2261 being driven by the respondent No. 1 rashly and negligently, dashed to Surendra Singh due to which he died. At the time of accident, the age of Surendra Singh was 22-1/2 years. He has undertaken training of compounder and, therefore, the claim was preferred. The learned Tribunal awarded a lump-sum amount of Rs. 1,50,000/- as compensation. 3. Heard learned counsel for the parties and perused the relevant record, specially the impugned judgment and award. 4. The contention of the present appellants is that the deceased was aged 22-1/2 years at the time of accident. He was a trained compounder and he was to get job in near future and could earn Rs. 7,000/- per month, but the learned Tribunal has not assessed these facts and has awarded only a sum of Rs. 1,50,000/-. The appellants have further submitted that in case of non-earning member, the notional income is provided in Second Schedule of the Motor Vehicles Act and Rs. 15,000/- should be taken as notional income and then the compensation should be calculated. 5. The contention of the present appellants is acceptable. It is not in dispute that the deceased was aged 22-1/2 years at the time of accident and he was having a bright future as he had undertaken training in nursing but it is not in dispute that he was earning nothing at the time of his death and hence for a non-earning member, Rs. 15,000/- per annum should be taken as his notional income and looking to the age of his dependents, the multiplier of 13 would be appropriate. The compensation thus, comes to Rs. 15,000 x 13 = 1,95,000/-. The learned Tribunal has already awarded a sum of Rs. 1,50,000/-. Thus, the compensation is being increased by Rs. 1,95,000/- Rs. 1,50,000/- = Rs. 45,000/-. 6. In view of the above, the appeal, therefore, is allowed and the compensation is increased by Rs. 45,000/- along with interest @ 7-1/2% on the increased amount from the date of filing appeal till actual payment is released.
