Judgment :- 1. Heard the learned counsel appearing for the parties concerned. 2. A counter affidavit, dated 12.7.2012, had been filed on behalf of the respondents. Paragraph 3, 4 and 5 of the counter affidavit read as follows: "3. I further to submit that on verification of original certificates, the petitioners application has been registered in the Director General Highways Department, Chennai5 and assigned his seniority number as 838 A in the waiting list. So for 455 persons have been provided jobs on compassionate ground and this respondent has been keeping the seniority list and filling up the vacancies as and when it arises. Therefore, this respondents are taking steps to provide jobs for the persons who applied for jobs on compassionate ground. 4. I am further to state that the office of the Director General, Highways Department, Chennai – 5, is dealing with all the compassionate ground applications, seeking jobs that are being received from all the Wings of Highways Department like Nabard and Rural Roads wing, National Highways Wing, Project wing and Construction and Maintenance wing etc. On confirming the genuineness of the facts contained in each application, number has been assigned chronologically. Hence, irrespective of his personal grievances, the petitioner had to wait for his turn as is done by other applicants. I state that when compare with other Government Department, this Department is getting more applications for the appointment on compassionate ground. Since most of the employees are working on the Highways as Gang Muzdoor and Road Inspectors and most of them are met with accidents. Hence this department is getting more applications than other departments. Therefore there is delay is providing jobs to the legal heirs of the deceased employees on compassionate ground. Therefore, this petitioner has to wait till his turn comes. 5. I submit that the appointment on compassionate ground is made only by way of seniority list. At the right time, the appointment order will be issued to the petitioner when his turn comes without waiting for any outside pressure. The petitioner has not satisfied the reasons given by the respondent about the procedures to be followed in the compassionate ground appointment has rushed to the court and filed the writ petition." 3. In view of the averments made in the counter affidavit filed on behalf of the respondents, in the paragraphs referred to above, this writ petition stands closed, as no further orders are necessary. No costs. Connected M.P.No.1 of 2011 is closed.
