JUDGMENT Rakesh Kumar Garg, J 1. On the basis of complaint filed by the petitioner, the respondent was summoned to face trial vide order dated 01.04.2005 of the trial Court, under Section 406/420 IPC. 2. Revision petition filed by the respondent-accused against the aforesaid order was dismissed by the Additional Sessions Judge, Faridabad, vide order dated 19.01.2007. 3. Thereafter, respondent-Ram Dayal was charge-sheeted under Section 409 of IPC by the Judicial Magistrate Ist Class, Palwal, vide order dated 22.08.2007. However, revision filed by him before the Sessions Judge, Faridabad was accepted vide order dated 8.10.2007 and the order of the trial Magistrate was set aside discharging the respondent-accused. The said order dated 8.10.2007 is under challenge before this Court, by way of this petition filed under Section 482 Cr.P.C. 4. Despite the fact, the instant petition has been filed as urgent, no one is present on behalf of the petitioner to assist the Court, even on the second call. 5. However, this Court has perused the averments made in this petition. What to talk of any material, there is not even any averment explaining the delay of 4½ years in challenging the aforesaid order dated 8.10.2007. 6. Thus, it seems that this is a frivolous petition filed by the petitioner by abusing the process of law for his ulterior motive. 7. Dismissed with costs which are assessed at 10,000/-. 8. The petitioner is directed to deposit the aforesaid cost with the Haryana Legal Services Authority, Chandigarh, within one month from today. In case, he fails to deposit the amount, the same shall be recovered by the said authorities, in accordance with law.
