Judgment :- T.S. Sivagnanam, J. 1. Heard the learned counsel appearing for the parties. By this writ petition, the petitioner seeks a mandamus forbearing the respondents from evicting the members of the petitioner Association from the Finishing Harbour Area of Kasimedu. 2. The petitioner Association, viz., ‘Coastal Community Protection Movement’ is a registered Association consisting of fishermen of the Fishing Harbour area. It is stated that the petitioner Association and other 2,00,000 fishermen are at present using the fishing Harbour in the Greater Madras Port Area. The grievance of the petitioner is that the first respondent – Chennai Port Trust, contravening the solemn assurance given by the second and third respondents to the fishermen, has now evolved a new project, which if allowed to be executed would ruin the fishing harbour constructed for the benefit of thousands of fishermen of Chennai Port Area, inasmuch the said project will deprive the very livelihood of lakhs of fishermen using the fishing harbour. 3. Mr. R. Muthukumarasamy, learned Senior Counsel appearing for the first respondent submitted that in order to resolve the dispute raised by the petitioner, a meeting has been convened and some settlement could be arrived at with the petitioner. 4. In the aforesaid premises, we dispose of this writ petition with a direction to the petitioner to participate in the said meeting and come to a settlement. Consequently, the connected miscellaneous petition is closed. However, there will be no order as to costs.
