Rajiv Shafma, J.— Heard Sri B.K.Saxena, Counsel for the petitioner and Mohd. Shakeel appearing for the contesting private respondent. 2. Late Sardar Dailip Singh instituted a SCC suit bearing no. 317 of 1982 against the petitioner Shanti Lal (tenant) seeking a decree for ejectment, recovery of rent and damages from the portion of the premises of House No. 312/23, Mohalla Lajpatnagar,, Chowk, Lucknow. This suit was decreed against the petitioner and as such the petitioner preferred SCC Revision No. 124 of 1983 before the Additional District Judge, Lucknow, which was allowed and the matter was remanded. The Trial Court again decreed the suit vide judgment and order dated 24.3.1990. The petitioner again, being dissatisfied with the order of the Trial Court, preferred SCC Revision No. 98 of 1990, which was dismissed. 3. Hence the unsuccessful petitioner has filed the instant writ petition. 4. This Court by an ad-interim order stayed the execution of decree for ejectment provided the petitioner deposits the entire decreetal amount and arrears of rent and damages including the damages pendentelite. 5. Today, when the case was listed, Sri Brijesh Saxena, Counsel for the petitioner states that he does not want to press the writ petition on merits and is ready to vacate the premises provided some reasonable time is afforded for searching the alternative accommodation. When the Court offered a years' time for vacating the premises, Counsel for the petitioner readily accepted to which no objection was raised by Sri Mohd. Shakeel appearing for the private respondent. 6. In view of the above statement and undertaking of the petitioner, the writ petition is disposed of finally with the direction to the petitioner to vacate the premises in question on or before 31 st March, 2013 positively and shall hand over the premises to the legal heirs of the respondent no.3, who have been impleaded in the instant writ petition. The arrears of rent up-to-date? including the rent payable upto 31st March,2012 shall be paid by the tenant to the landlord within two months from today. _
