Judgment :- 1. The petitioners were employed as Sanitary workers on daily wages. They were employed on daily wages for a long time even prior to 31.12.1996. 2. The Government issued G.O.Ms.No.199, MAWS Dept., dated 12.8.1997 directing the Municipality to pay consolidated pay to the sanitary workers working on daily wages basis for three years and thereafter to regularise their services in the scale of pay. 3. The petitioners were granted consolidated pay on 27.11.1998 as per G.O. No.199, MAWS Dept. dated 12.8.1997. They completed three years of service on 27.11.2001, but, they were not regularised from 28.11.2001 as per G.O.Ms.No.198, MAWS Dept., dated 26.10.1998. On the other hand, they were regularised in service with effect from 23.6.2006 by an order dated 4.8.2006. Hence the petitioners have filed this writ petition seeking for a direction to regularise their services from 28.11.2001 as per G.O.No.199, MAWS Dept., dated 12.8.1997 and to pay them monetary benefits pursuant to their regularisation. 4. No counter affidavit is filed. 5. The writ petition is taken up for final disposal since it is covered by a decision of this Court dated 12.10.2011 reported in 2012 (1) MLJ 240 (M.ANANDAN & OTHERS Vs. SECRETARY TO GOVT. OF TAMIL NADU, MAWS DEPT., FORT ST. GEORGE, CHENNAI & OTHERS) 6. Heard both sides. 7. The matter is squarely covered by my decision dated 12.10.2011 reported in 2012 (1) MLJ 240 . The issue relating to regularisation of service of daily wage sanitary workers who were subsequently brought on consolidated pay by G.O.No.198 was taken to Apex Court and the matter was settled. The same was followed by me in the decision dated 12.10.2011 reported in 2012 (1) MLJ 240 . 8. In view of the aforesaid order, the writ petition is allowed and a direction is issued to the respondents to regularise the services of the petitioners with effect from 28.11.2001 and a further direction is issued to the respondents to pay monetary benefits to the petitioners from 28.11.2001, within a period of eight weeks from the date of receipt of a copy of this Order. No costs.
