Judgment :- 1. Heard the learned counsel appearing on behalf of the petitioner and the learned counsels appearing on behalf of the respondents 1 to 3. 2. At this stage of the hearing of the Writ Petitions, the learned counsel appearing on behalf of the petitioners, had submitted that it would suffice, if the third respondent is directed to conduct an enquiry, with regard to the proposal, dated 10.07.2012, to shift the TASMAC Shop No.7893, located at Door No.1/1A, Philomina Nagar, Nanjikottai Road, Thanjavur, pursuant to the representation of D.Govindarjan, the fourth respondent in the above Writ Petitions. 3. The learned counsels appearing on behalf of the respondents have no objection for this Court passing such an order. 4. In view of the above, the third respondent is directed to conduct an enquiry and to pass appropriate orders thereon, on merits and in accordance with law, after giving an opportunity of hearing to the petitioner, as well as the fourth and the fifth respondents, in W.P.No.23387 of 2012, within a period of four weeks from the date of receipt of a copy of this order. However, it is made clear that until the third respondent passes an order, pursuant to the said enquiry, as directed by this Court, the TASMAC shop bearing No.7893, located at Door No.1/1A, Philomina Nagar, Nanjikottai Road, Thanjavur, shall not be shifted. 5. With the above directions, these Writ Petitions are disposed of. No costs.
