Judgment :- M. JAICHANDREN, J. 1. Heard the learned counsel for the petitioner, as well as the learned Additional Government Pleader appearing on behalf of the respondents. 2. At this stage of the hearing of the writ petition, the learned Additional Government Pleader appearing on behalf of the respondents had submitted that a criminal case had been filed before the Judicial Magistrate I, Pollachi in Crime No.204/2012 for the offences under Section 21(1) of the Mines and Minerals (Development and Regulation) Act, 1957, read with Rule 36(a) of the Tamil Nadu Mines and Minerals concessions Rules, 1959, and under section 379 I.P.C. Therefore, it is open to the petitioner to move the Magistrate Court concerned, by way of an appropriate application, for the release of the vehicle in question. 3. In view of the said submission made by the learned Additional Government Pleader appearing on behalf of the respondents, the present writ petition stands dismissed. However, it is made clear that it would be open to the petitioner to file an appropriate application, before the criminal Court concerned, for the release of the vehicle in question, in the manner known to law. No cost.
