ORDER N. Ananda J.—The petitioners arrayed as accused 10 to 13 in C.C. No. 128/2010, pending trial for offences punishable under sections 4(2) & 7(c) of the LPG (Regulation of Supply and Distribution) Order, 2000 and sections 3 & 7(3) of the Essential Commodities Act and also for offences punishable under sections 406, 407, 465, 468, 474 & 420 r/w sections 34 & 36 IPC, have filed this petition to quash the proceedings pending therein. I have heard the learned counsel for petitioners and learned HCGP for respondents. 2. The documents filed under section 173(5) Cr.P.C, accepted at their face value would reveal "the following:- Accused 10 to 13 had created bogus subscription vouchers to distribute LPG gas cylinders. Accused 10 to 13 have distributed LPG gas cylinders to bogus subscribers, instead of supplying LPG gas cylinders to registered LPG consumers. 3. During the course of investigation, bogus subscription vouchers (84 in numbers) were seized from the possession of accused No. 11. The investigation records would reveal that accused 10 to 13 by creating bogus documents were selling LPG gas cylinders in black market and depriving LPG gas cylinders to registered LPG consumers. 4. At this stage, there are no reasons to suspect the contents of documents filed under section 173(5) Cr.P.C. The first information and statements of witnesses are supported by seizure of incriminating articles from petitioners. Therefore, there are no grounds to quash the final report. The petition is accordingly dismissed. It is made clear that observations made in this order shall not be construed as expression of opinion on merits of the case during subsequent stages of the case.
