JAIN-I, J.—Counsel for respondent/claimant has filed an application for modification of the order dated 24th October, 2008 passed in Stay Application No.2725/2008, whereby claimant/ respondent No.1 was given liberty to withdraw the interest accrued on fixed deposit on monthly or quarterly basis. 2. Submission of learned counsel for respondent/claimant is that it is a matter relating to injury to the claimant and at present the claimant/respondent No.1 is not in a position to move even his fingers and is confined totally to bed. His nerves system has almost failed and he has lost control over his body parts. His family has no source of earning and is not able to bear even his medical expenditure. In these circumstances, he is not in a position to withdraw the interest accrued on the fixed deposit of Rs.3 lacs, therefore, in the interest of justice that instead of respondent No.1 personally, his wife Smt.Vandana Meena may be permitted to withdraw the amount of interest accrued. 3. Consequently, application filed by respondent No.1 / claimant is allowed. The applicant, Smt.Vandana Meena, wife of respondent No.1/claimant Ghanshyam is allowed to withdraw the amount of interest accrued on fixed deposit till now as per order of this Court dated 24th October, 2008. The applicant, Smt.Vandana Meena is also permitted to withdraw the amount of interest in future also, during pendency of this appeal. The concerned Bank is directed to comply with this order. 4. The application (37071) stands disposed off.
