body2012
TRIVEDI, J.—The present appeal has been filed by the appellant under Section 173 of Motor Vehicles Act, 1988 seeking enhancement of compensation awarded by the Motor Accident Claims Tribunal, Bundi in MAC No.420/2006 vide award dated 24.1.2011, whereby the Tribunal has awarded Rs. 1,10,000/- for the injuries sustained by the appellant as a result of the accident caused out of the use of the offending vehicle being No.RJ-14 G-6951. 2. It has been submitted by learned counsel Mr. Jitendra Bajaj for the appellant that the Tribunal has not considered the permanent disability sustained by the appellant to the extent of 27% and has awarded lumpsum award of Rs.1,10,000/-. According to him, the said amount is meagre one and deserves to be enhanced. 3. In the opinion of this Court, there is no substance in the said submissions made by the learned counsel for the appellant, inasmuch as the Tribunal has observed that the appellant had not examined the concerned Doctor who had given the disability certificate. Tribunal awarded the compensation considering the bills of medicines and other documents produced by the appellant and has awarded the compensation to the extent of Rs.1,10,000/-. There being no perversity or illegality in the said award made by the Tribunal, the same deserves to be confirmed. Appeal being devoid of merits deserves to be dismissed and is dismissed in limine.
