TRIVEDI, J.—The present appeal has been filed under Section 173 of Motor Vehicles Act, 1988 seeking enhancement of compensation awarded by the Judge, Special Court (Communal Riots), Motor Accident Claims Tribunal, Jaipur in MAC No.1427/2004 (1542/97), whereby the Tribunal has awarded Rs.58,000/- for the injuries sustained by the appellant-claimant as a result of the accident occurred out of the use of vehicle being Mini Bus bearing registration No.RJ-14 15M-4305. 2. It has been submitted by learned counsel for the appellant that the appellant had sustained fracture for which she was required to be admitted in the hospital for about 10 days and the Tribunal has awarded the meagre amount of compensation of Rs.58,000/-. According to him, the said amount deserves to be enhanced considering the facts and circumstances of the case. 3. Having regard to the submissions made by learned counsel for the appellant and to the impugned award made by the Tribunal, it transpires that the Tribunal has taken into consideration the nature of injuries sustained by the appellant as also the disability sustained by her. The Tribunal has awarded just compensation towards the pain and suffering, permanent disability and the actual expenditure incurred by the appellant. The said award being just and proper, it does not call for any interference of this Court. There being no substance in the appeal, the same is dismissed in limine.
